Terms of Use

1. Terms:

By installing and using the Nonfollowers app (the "App") or visiting www.nonfollowers.com or its subdomains, including app.nonfollowers.com where our signed-in web application is hosted (collectively, the "Site"), you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the App or the Site. The materials contained in the App and the Site are protected by applicable copyright and trademark laws.

2. Site Terms of Use Modifications:

Nonfollowers may revise these terms of use for the App or the Site at any time, with reasonable notice posted on the Site or within the App. By continuing to use the App or the Site after such revisions, you are agreeing to be bound by the then-current version of these Terms and Conditions of Use.

3. Service:

Nonfollowers provides services to analyze user-exported data from Instagram. On the Mobile App, this analysis runs locally on your device and we do not store the contents of your raw export information on our servers. On the Site, the analysis functionality is provided through our signed-in web application at app.nonfollowers.com, and you must create an account and sign in to use it; signed-in Site users' uploaded Instagram data and analyzed results are stored on our servers so the experience can persist across sessions and devices. Our handling of this information is described in our Privacy Policy.

4. User Accounts (Site):

Accounts on the Site are created via Google Sign-In or via an emailed sign-in link (sometimes called a "magic link") sent to an email address you provide. By creating an account, you represent that you are at least 13 years old (or the minimum age required in your jurisdiction to consent to the processing of your personal data without parental consent) and that the email address and any other information you provide is accurate and belongs to you. You are responsible for maintaining the security of the Google account or email account you use to sign in and for all activity that occurs under your Nonfollowers account. You agree not to share your account with others or to create multiple accounts to circumvent any limits, suspensions, or other enforcement of these Terms. We may suspend or terminate accounts that violate these Terms, as described in Section 10.

5. User Conduct:

You agree not to use the Nonfollowers services for any illegal activities or for any other purpose that is not permitted by these Terms and Conditions of Use. In particular, you agree not to: (a) access the App or Site through any automated means, bots, or scrapers; (b) reverse-engineer, decompile, or disassemble any part of the App or Site; (c) use the App or Site in any manner that violates Instagram's or Meta's Terms of Service; (d) upload, transmit, or store through the Site any data that you do not have the legal right to share, or that contains personal information of other individuals beyond what is contained in your own Instagram export; or (e) attempt to gain unauthorized access to other users' accounts or to our systems.

6. User Content:

Any Instagram export files, analyzed results, or other content that you upload, submit, or generate through the App or the Site is referred to as "User Content." You retain all ownership rights in your User Content. You grant Nonfollowers a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, process, and display your User Content solely as necessary to provide, secure, maintain, and improve the service to you. This license ends when your User Content is deleted, except to the extent we are required to retain copies to comply with our legal obligations or as described in our Privacy Policy. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate the rights of any third party or any applicable law.

7. Fees & Payments:

Certain services require payment. Subscription fees are charged according to the plan you select. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Payments for Mobile App purchases are processed by Apple or Google and charged to your App Store or Google Play account at confirmation of purchase. Payments for purchases made through the Site are processed by Stripe, our third-party payment processor, and charged to the payment method you provide. Nonfollowers reserves the right to change the prices for its services at any time. Any subscription fee change will become effective at the end of the then-current subscription period.

8. Refunds:

Refunds for purchases made through the Apple App Store or Google Play are subject to those platforms' refund policies and are processed by Apple or Google directly. Nonfollowers does not control or process these refunds. Where applicable, statutory consumer rights (such as the EU 14-day right of withdrawal for digital content) remain unaffected.

Refunds for purchases made through the Site are processed by Stripe, our third-party payment processor. To request a refund for a Site purchase, please contact us directly and we will review your request in accordance with applicable laws and our refund policy. 9. Subscription Cancellations:

You may cancel your subscription renewal at any time through your account store settings (Google Play Store or Apple App Store) for Mobile App subscriptions, or through your account settings on the Site (which are managed by Stripe's customer portal) for Site subscriptions. You will not receive a refund for the current period, and your access to the service will continue until the end of the current period.

10. Account Termination:

You may request deletion of your Nonfollowers Site account, including the Instagram data you have uploaded, at any time through the Contact form or by emailing hello@nonfollowers.com. We will process your request within a reasonable period, except where we are required to retain certain records to comply with our legal obligations. We may also suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or if required by law. Termination does not entitle you to a refund of any fees already paid, except where required by applicable law.

11. Liability:

The App and the Site are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Nonfollowers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or the Site. Nonfollowers' total aggregate liability shall not exceed the amount you paid to Nonfollowers in the twelve (12) months preceding the claim. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law.

12. Intellectual Property:

Nonfollowers owns all proprietary rights in our platform. Unauthorized use of our service may result in legal action(s).

13. Disclaimer of Affiliation:

Nonfollowers is not affiliated with, endorsed by, or sponsored by Instagram, Meta Platforms, Inc., Google LLC, or any of their subsidiaries. All Instagram, Meta, and Google trademarks, logos, and brand names are the property of their respective owners.

14. Governing Law:

These Terms and Conditions of Use shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of the applicable jurisdiction.

15. Severability:

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
